不是 : 薪水 / 26天 / 8小时 = 每小时 RMX 吗？

卡姐，请问你，同事8月8号生，两个月产假后，10月8号上班，当日就给辞职信。
听别人说，老板可以sue她，拿了两个月的产假就辞职，可以叫她赔3个月的薪水，
有这样的事吗？
她是去年7月进来做的，三个月试用期后才怀孕的，就是说才做了一年左右。
老板可以sue她的吗？

你的同事没触犯任何劳工法的rule..只要她呈辞后serve 完notice period 就可以了。。

谁都可以sue 人的，sue 不sue 得进又是另一回事咯。。

现在的人，动不动就喊sue, 找到那些没生意拍苍蝇的律师或许可以很快处理，可是法院排期就。。。 再加上一些太小的case, 根本不受理。。

计不计较在于事情的严重性和当事人的接受程度。很多人不太明白，才会讲出一些看起来很有人情味的话。
要知道，其实法律本来就是一物二用。一，用来对付犯法的人；二，用来保护民众在强权下避免被剥削/欺骗/伤害。

在这个资本主义社会，在劳动市场里，拥有强权的是雇主，而需被保护的民众，就是员工。。劳工法也因此而被制定。

有时员工没和公司算到足，不是不计较，而是不知道。不计较和不知道，差很远。。

当然，有许多员工都是抱着多一事不如少一事的心态。这是我们的文化，很难改变。

相信许多目前月入还未达到RM3000 的员工都很想知道政府所承诺的那RM500， 到底如何得到，又要通过甚么管道来申请。

不过，这项援助有一个有趣的地方，就是如果是已有家室的人民，必需是全家人的收入低于RM3000才能申请。

根据 IRB (Inland Revenue Board) 的资料，其实真正落实是在2012年一月份。 那么，在申请的这个过程，需先注册eKasih.

eKasih 是‘国家贫困人士的数据库’，也是相关机构对贫困士民施于援助的一个管道。自2007年成立以来，已有331,000贫困家庭注册。目前还没注册的人民可从 IRB 网站下载以下这张eKasih form.

KUALA LUMPUR (Oct 12, 2011): The one-off cash handout of RM500 to households with an income of less than RM3,000 a month, as proposed in Budget 2012, will be disbursed from January.

Deputy Finance Minister Datuk Dr Awang Adek Hussin said yesterday that the money will be paid out in stages as there was no fixed timeframe for the payment.

It will be disbursed via several agencies, with the Inland Revenue Board (IRB) taking the lead. Other agencies listed are Pos Malaysia, Bank Negara Malaysia and Bank Simpanan Nasional.

“The IRB will be the lead agency because it has the records for active and non-active income tax payers. We are working on the infrastructure to properly implement this, and will begin disbursing the money in stages from January next year,” Awang Adek said.
Prime Minister Datuk Seri Najib Abdul Razak had earlier announced the one-off cash relief when tabling 2012 Budget in Parliament last Friday.

According to the Budget proposal, RM1.8 billion has been allocated for the aid which is expected to benefit 3.4 million homes or 53% of households in the country. The money will be given out via banks and post offices.
Awang Adek said the IRB will also use the e-Kasih database to obtain information of the people who are eligible for the aid.

E-Kasih is the Centralised National Poverty Databank used by relevant agencies to channel aid to the poor. The database, which is overseen by the Implementation Coordination Unit of the Prime Minister’s Department, has 331,000 households registered since its launch in 2007.
Households not registered with eKasih can download the application form for the payment from the IRB website, Awang Adek told a press conference after opening the National Tax Seminar 2011 at Putra World Trade Centre.
Printed forms will also be distributed soon.

IRB chief executive officer Datuk Dr Mohd Shukor Mahfar said only households that earned a cumulative income of less than RM3,000 will be eligible.

“We are working on a way to check the incomes of the husband, wife and children who live in the same house to determine eligibility,” he said.
He said eligibility of children who do not live with parents was being discussed, but working children and those who paid zakat (tithe) may be considered.

Awang Adek said the ministry and agencies are working closely to create an effective system for disbursement of the cash.

Daily pay = RM2150 / 365 days = RM5.89
Paid days (for employee's termination) = 7 years (years of services) x 20 days (paid days for 7years service' entitlement)  = 140 paid days

Entitled compensation = 140 paid days x RM5.89 = RM824.6

想问下，daily pay 不是
(RM2150 x 12) / 365 days = RM70.68

其实在以前是不需要给外劳EPF的。但自1/8/1998年开始，凡薪金低于RM2,500的外劳，雇主都需帮他们缴交EPF。

在何种情况下，外劳没有EPF?

1） 薪金高过RM2,500并只持有employment pass 和 visit pass 的外劳 （临时性的）
2）只持 territorial pass  的泰国劳工
3）外籍女佣

SOCSO只cover 马来西亚员工及永久居民，外劳则covered by 'Workmen's Compensation Act 1952' （1952年雇员赔偿法令）。

如果外劳的薪金是RM500 以下，雇主必需帮外劳买保险 （workmen's compensation insurance）以备外劳工作意外受伤所需之赔偿。
尤其争对那些体力劳动外劳。

那个除365天的daily pay 是专作退休利益（retirement compensation) 之计算。

如果只是纯粹算每个月的日薪，那么就是： Monthly Basic Salary / 26 days

你的永久居民是指外劳持有永久居民权，还是本地永久居民？

如果是外劳citizen, 依然是 covered by 'Workmen's Compensation Act 1952' 。
