想迅問關於房屋贷款透支延迟客户权利调查过程吗:

想迅問關於房屋贷款透支迟客户权利调查过程吗:

我有一个Refinance贷款,去年四月已经签署,当我签署验银行贷款合约,我有告诉律师和银行,我需要的资金,要尽快帮我办好. 他们告诉我,大约需要3〜4个月的时间来获得资金。我被告知我的房子Developer需要出strata tile才可以process.由于这我找了DEVELOPER和DEVELOPER SOLICITOR谈,希望他们可以尽快帮我搞定.

时间一天天过,我有打电给讯问我的律师, 一边(RefinanceSolicitor)说还没有受到回应一边(DeveloperSolicitor)说他(RefinanceSolicitor)没有写Letter ofInstruction给他。。搞来搞去, 我就一个一个问..

搞来搞去搞到现在。。我的loan还是延迟cash out 贷款还没有搞定.. 我就写信书面投诉我与和银行贷款经有点理纠纷;结果在不甘愿情况下; 才跟我揭晓solicitor chronology event.

The key date for documentation 17/9,Received a copy of the Transfer duly executed by the developer and the borrower, and KNP requested theredemption statement, which
obtained on 21/10.


29-04-2014:
Kee Norainn & Partners (KNP) received the Letter of
Instruction (LI)
01-05-2014:
Borrower executed the loan documents under Assignment based
on the Offer Letter
05-05-2014:
Requested the developer’s confirmation on the property
(necessary for property without title)
06-06-2014:
KNP received reply from the developer that the strata title
out. KNP has to change the Loan Docs (charge doc)
In June, 2014
Borrower re-executed the Loan Docs (under charge)
17-09-2014:
-Received a copy of the Transfer duly executed by the
developer and the borrower
-KNP requested the redemption statement

26-09-2014:
Forwarded Asset Purchase Agreement (APA) for execution
· Islamic loan – ABB’s requirement for theAPA to be
executed first
02-10-2014:
Received APA from ABB duly executed
09-10-2014:
Sent the FA/Charge/ASA to ABB for execution
15-10-2014:
Received the rest of the loan docs from ABB duly executed
21-10-2014:
KNP received the redemption statement
11-11-2014:
Paid the stamp duty on FA
· first notice of stamp duty without 20%rebate for
Islamic loan. KNP resent the application for re-assessment
– 6/11/14: new notice of stamp duty issued by the stamp
duty department with the correct stamp duty
18-11-2014:
-Advised for redemption
-ABB holds the release for fire insurance policy for the
building
01-12-2014:
KNP received fire insurance policy for the building and
forwarded to ABB
05-12-2014:
Redemption sum released but no notification from ABB– KNP
chasing for payment notification
12-12-2014:
KNP forwarded the redemption sum to ABB (without
notification) with Receipt and Reassignment (RNR)
Pending RNR

We wish to highlight that the delay in completing the
release of loan is mainly due to the issuance of strata
title after the loan is granted to the borrower. The new
loan shall be secured by way of legal charge. The developer
also taken very long to execute back the Transfer MOT.

我大概了解银行赖我的Strata tile from developer delayMOT haveexecuted from developer cc copy mentioned has executed on 17/9/2014。可是我发现收到DEVELOPER CC的信中 MOT201477日,但是SOLICTOR17/9/2014收到. 我有点怀疑,想跟拿Developer solictor chronology of event,但是那solicitor 好想不给,说没有跟我的LOAN有关系。

我想追究问题到底是谁的责任,现在每个都在cover自己.. 要如何调查?

我想claim fault party for the delay of process. 需要向BarCouncil 提出报告先吗?或需委任另一名律师索
