求助：SPA 签了，头期钱给了，做么还没 Stamp?

各位英雄好汉，小弟买了一个还没有建的condo单位，6月7日在Developer的律师楼签了SPA合同，当场也给了Downpayment 支票，支票在6月尾过账了可是SPA合同到今天7月24日都还没有盖章，developer的SA一直推三推四，说帮我问问，问到花谢了都没有答案。律师楼就推卸责任说developer还没行动，叫我自己去问developer。
请问这是违法的吗？还是正常的？有些担心。。。。纳闷中。。。求助啊~~.gif)

合同没签还是没有stamp ??
如果只是没有stamp, 没问题的。 一份合约没有stamp他还是一份有效的合约 。
如果没有签才是问题！ |

没有stamp可能是plan permit还没有批准。有很多发展商连lay-out和building plan都还没批准前就来个什么什么soft launch,pre-launch来拿人家的头期，有些还要等上整年也不出奇！
更好笑的是当SPA连stamping都没有时，很多那些发展商的律师却迫不及待叫买主来签那loan agreement先。那简直是只为了自己袋袋平安，还管得着买主的死活？ |

其实这样对我很没有保障,问发展商就是说不出什么原因。感觉好像被欺骗。
其实发展商和律师楼这么做是违法吗? |

保障？其实以马来西亚的实况来说是太少了！！！
尤其以现在大家都在hot on the heel的假象来看，买家只有自求多福啦！
以物业发展商内定的法规，签了约后必须在三年（36个月）里交屋。这就造成了他们尽可能的等到一切都批准和全安排妥当后才stamp那合约，以求安全嘛！
你可要常常去关注才好。听说多年前曾经有多宗讼诉就搞的至今还没完没了，有些连发展商和律师都不见了呢！

stamping 的日期和合约的日期是可以不一样的。
迟stamping不代表我可以迟点交屋子。 如果买家是担心的，你大可以叫律师楼把合约的日期放你签名的日期。
如果你会处理，迟stamping对买家根本没有影响。
一般的人认为合约要stamping才有效这想法是大错的错的！！

In answering your doubt as to the "effective date" in a SPA.
Every SPA would have a date of agreement which supposedly signifies when the obligations of the parties are to begin. It's obvious that the effective date actually starts from the date the purchasers "first paid their deposit(10%?)" regardless of the date stated in the SPA.
However, nowadays developers would sometimes ask their panel lawyers to collect such upfront deposit through appointing their lawyers as "stakeholders". Such stakeholder agreements (or often times in the form of a letter) may be valid if signed by one purchaser who is "desperate" to lock in a unit or at first signed an offer to buy from the developer instead of the other way round ! The developer(s) is therefore, still NOT a party in the stakeholding contract yet !? And again, the so-called SPA will only be effective when it is duly stamped and dated !
Remeber, at first step you are merely requested to buy from the developer and following by an unstamped "agreement" subjected to become a contract ! It is the second step when it is a dully executed (and stamped) contract will thus be bindingly recognized !? All contracts are agreements but NOT all agreements are contracts.

就以买主在那由自己offer to buy from the developer（还没批准证）的事件说起。。。
假设在relevent/required的发展准证被刁难或不批准时，签了loan agreement也给了费用的买主怎么办？
兴讼讨回公道？就如LZ所说的老张唱的。。。等得花也谢了？再记住it was you to offer to buy and the acceptance is...still pending ! Anything that happened ? None of our business, neither is the lawyer's！
