银行里的23千储存被冒领!(事情发生已经1年有多了,钱还没有拿得回来)

Dear Sir/Madam,
I am writing to do the understanding of my case and I wish to settle this case as fast as possible and also to make a complaint about the efficiency & verification process of Public Bank.
My brother (XXXXX) had a deposit account ( XXXX ) on public bank already few year . Since this account had not withdrawn any money, only then deposit. On 11-9-2009 , we’re found that the account has been peculated by someone altogether RM23,000 in 7 times. Though the closed circuit television, we can know that there are involves has 2 or maybe 2 above criminals.
On the same day , 2 of the criminal is arrested on the scene with the stolen goods that is my brother‘s IC and bankbook, all evidence including the IC and bankbook also as well as the 7 times peculates closed circuit television. The criminal was detained by police and now the courtyard already had a decision.
At the moment, I go to the 2 of the involves branch’s of public bank to inquiry and do the understanding that the matter need to solve but I’m waiting long time, the staff one pushes one, is not willing to reply directly my question, nobody transfers me responsibly, finally told me all high-level staff such altogether go out. A whole bank no any manager level character! I go to the bank many times, but all times also like that. I such a fool to let them pushes here pushes there.
First, I am disappointed that the processing manage of public bank’s at this event, I felt I am not respected for them and they waste my time also.
Second, I am strongly suspect the verification process of public bank.
1.Why the bank can let the criminal to peculates the deposit that the criminal is only the 14 year old boy?
2.The verification process has a serious crack, the staff makes a mistake seriously.
At the moment the criminal peculates the deposit, the staff didn’t check identify the money withdrawal. The first time the criminal’s peculates on 25-8-2009 (ref to doc) at the branch of JALAN SXXGAI BXXX, the left hand side of the bank slip have 2 of the signature of customer, the first and second one respectively of “xxxxx” and “ XXXXX“, please take a attention of the bank slip that this 2 signature had the cop of “cancelled” , is surely cop by the staff of Public bank. Then, at the right hand side of bank slip also have a signature of “ XXXXX”, it hand deleted by someone. Above this signature, is the correct sign of my brother “XX”.
Under such situation, the bank staff have not had the suspicion to customer's of this behavior? The customer withdraw the money that signed continuously 3 times has signed mistakenly, and also his just a 14 year-old boy, but the bank had not suspected completely to him? Moreover, I had the reason to believe that when the criminal signed the wrong name continuously under the situation, the bank staff let him look at inside the bank book the correct signature, therefore his only then might 4th time sign again, signed is correct.
Besides the signature, the verification process is include the checking of customer’s thumbprint and IC. Through the closed circuit television, may very clear to see that the criminal has show his thumbprint to the bank staff. The manager personally tells me, under this situation that the bank staff still lets him to withdraw the money , that mean this is very obviously is the mistake of the bank staff. The thumbprint is totally not match with my brother , then why the bank still lets them withdraw the money and even had 7 times at 2 of the different branch!
Otherwise, this account is never withdraw any money from the time is open until now and also this is just a 15 year old child‘s account. From 25/8 to 10/9 only the very close day but the account withdraw the money continuously 7 times, each time at least RM2000, total RM23000, the such short time withdraw such a big number of money, why the bank will not have any suspicion regarding this completely?
In this case, 3 out of 7 times are the same counter and even same staff to take up, I think that she should take the partial responsibilities for this event. The matter occurred already had few months until now, but the bank completely not have any reply for me.
How can so many verification process but also lets others for peculates? If the bank may prevented the 1st time peculates occurs, then does not have the following other 6 events occurs!
Finally, I totally unbelievable that the bank such a good reputation but the verification process system is like that. We save our money into bank is because of believed the security of bank,the bank has the duty to keep secret of customer’s information and may protect our property but actually is not like that !
I hope you will give due attention to this matter, please look clear these 7 times peculates CCTV, may understand how to your bank's system.
This money I m rush to use for my grandfather’s operation fees, because of the peculates’s occur, his condition delayed could not obtain the treatment. Please as soon as possible carry on your internal investigation, then reply to me the answer. Its for me to be possible to go to search for other unit to assist to help to solve this matter.

隔天银行就有人打过来说
“你们的email我们已经收到了。。。。。。我看到你们的email有cc去给bank negara。。。。。你们有把email send去给bank negara吗。。。。。。。。?”
“有”
“真的send去给bank negara了哦。。。。。”
“对”
“。。。。。。。。。。那。。。那。。。我们会尽快解决的。。。。”
她说话顿下顿下的,好像很怕那样,尤其是一直的说bank negara,很明显他们是很怕bank negara。 |

一个星期后的今天,他们又打来了,原本还想说要再send email过去骂他们整个星期了还无声无息完全没有回我交待这事情,但是他们这么巧今天就打过来了。
下午打来,就很急的叫我男友立刻去银行,他们决定一人一半!还说如果要等police那里的话,就要等很久才可以解决的了。
我男友吓了一跳,幸好还是冷静的想到说,不要立刻决定先,应该要想清楚,就回复说明天先,明天才去银行。
他们这么说,就是想大家私下解决,如果要正式的通过police,正式的来做的话,就要等很久。
问题是,言下之意如果正式的做是不是会赔完先?如果是我们不介意等久点。
但是可以肯定地是,他们害怕,他们不想事情搞大,不想让外面的人或者bank negara知道,要掩盖。
现在很矛盾就是
一,收下RM11,500,亏RM11,500?
二,正式的来做?可是到时候或许会完全不赔,那就直接亏掉RM23,000,但是如果搞大之后全部赔完,那就拿回RM23,000?
各位的意见如何?
前提是,不可否认,是我们自己不见ic先,但是这事情银行也犯了非常大的错误。 |

银行要跟你一人一半,就证明了他们知道自己理亏,也知道自己处于下风
提出跟你一人一半是为了减少银行的损失
在这种情况下你一定要继续坚持给压力银行要他们赔足100%
一分钱也不能少包括利息必须要算到银行陪钱那天为止 |

早跟你说了银行非常害怕Bank Negara
如果你早一点寄投诉信去说不定早就拿回钱了
迟点Bank Negara的人还会跟你follow up你的投诉解决了没有
所以在你是正确的一方的情况下完全不需要害怕银行
因为你不但可以要求银行全额赔偿
甚至还可以对银行的疏忽提出诉讼要求额外的赔偿

明天我男友去到银行,就打算说一直的对他们施加压力,说为什么你们银行可以这样的?给个交待我们!凭什么出钱给人盗领之类的话!怎样说现在打底可以拿回一半,就大家扯破脸争取到底! |

之前想到说是我们不见了ic,错在先,又担心银行那条免责条列说不见了ic,bankbook要汇报不然在汇报之前被盗领了就不关银行的事,就是因为这样所以有所顾忌,就打算说继续等下吧,或许银行会很快解决的。但是听取你们的意见之后,都不知道自己在等什么!所以还是你们对!就写信投诉你!真的很有效! |

我非常同意上面几位大大。这个银行自己错,withdraw 6-7次了还不会发现吗。。。再说是rm23k哦。。。亏一半怎么行。。如果给一个穷人很辛苦存来的钱,现在银行说一半。。这是什么道理。
楼主有cc给bank negara不要怕他们了,到时侯就看他们怎么解决,你要的是100%,这是顾客权利和他们该这么做的。
一个指纹和小孩拿这么多不会提妨吗,反而有人提很多钱就会问为何拿这么多。。。可是小孩拿几千又好多次。。。摆明是银行犯很大的错。这种怎么让其他人安心存钱啊。
坚持要100%。。要准准23k...不能扣几百快或什么(要银行给很好理由) |

楼主男友已为这案件奔波了那么久,还要赔11.5k?
没有叫他们赔偿精神上的损失就很给面子了,跟他们纠缠到底吧。 |

我觉得你应该坚持到底,怎么看都是他们的错,为什么还要你们赔11.5k?
他们犯那样离谱的错就要他们赔足100%,不然下次再有这样的错误要谁负责?难道又是我们这些顾客吗?
实在可笑!如果是这样我们存钱在这间糟糕的银行根本没有任何利益可言。 |

存钱在银行就是要银行能好好保管。。。他们连最基本的有问题还说一人一半。。这个就相等要顾客亏钱。他们错,顾客亏,天理何在。 |
