如：

A 跟 B 打民事官司

B 报警， 说A捏造假證據

A 被警方召傳 给口供

A 给了口供

刑事程序法典第 112 条文下的口供书 (Pernyataan Keterangan) 不可以用在民事案件里。。


民事案件你可以向法庭申请 Rules of High Court 1980 第 26 条例下的 Interrogatories Summons 。。

Rule 1. Discovery by interrogatories (O 26 r 1)

(1) A party to any cause or matter may apply by summons in Form 48 to the Court for an order- (a)  giving him leave to serve on any other party interrogatories relating  to any matter in question between the applicant and that other party in  the cause or matter; and (b)  requiring that other party to answer the interrogatories on affidavit within such period as may be specified in the order. (2)  A copy of the proposed  interrogatories in Form 49 must be served with the summons by which the  application for such leave is made. (3)  On the hearing of an application under  this rule, the Court shall give leave as to such only of the  interrogatories as it considers necessary either for disposing fairly  of the cause or matter or for saving costs; and in deciding whether to  give leave the Court shall take into account any offer made by the  party to be interrogated to give particulars or to make admissions orto produce documents relating to any matter in question. (4)  A proposed interrogatory which does not  relate to such a matter as is mentioned in paragraph (1) shall be  disallowed notwithstanding that it might be admissible in oral  cross-examination of a witness. (5)  If an order is made it must be in Form 50 and must be served by the applicant on the party against whom it is made. (6)  Interrogatories must be answered by  affidavit in Form 51 and the affidavit must be filed and a copy thereof  served on the party interrogating within the time named in the order.

可不可以跟警方申請和得到一份 "刑事程序法典第 112 条文下的口供书" ?

Police Report (Seksyen  107 KTJ) 可以给你，但是 Cautioned Statement (Seksyen 112 KTJ) 肯定不会给你的。。



就算给你花钱买到那份口供书 (Cautioned Statement) ，对方律师肯定会挑战警方口供书在民事案件的合法性(Inadmissible Evidence) 。。
